Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and Ratera Yazılım ve Bilişim A.Ş. (“SunWise”, “we”, “us”) governing your use of the SunWise iOS application and related services (the “App”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

Health & safety — read this first. SunWise is a wellness and informational tool, not a medical device, and it does not provide medical advice. UV index, sun-time recommendations, and vitamin D figures are estimates produced by models — not measurements, diagnoses, or a substitute for professional judgment. Sun exposure carries real risks, including sunburn, premature skin ageing, eye damage, and skin cancer. Never use SunWise to maximize UV exposure or tanning beyond safe limits. Always follow the guidance of qualified healthcare professionals and public-health authorities, and consult a doctor before making decisions about sun exposure, vitamin D, or your health — especially if you have a medical condition, take photosensitizing medication, or have a history of skin cancer.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, for your personal, non-commercial use, in accordance with these Terms and the Apple App Store Terms of Service. This license is the Licensed Application End User License Agreement for the App (see §11).

2. Subscriptions & billing

SunWise offers auto-renewable subscriptions and may offer one-time (non-consumable) purchases such as a lifetime offer. Prices, billing period, and features are shown in the App before you buy.
Payment is charged to your Apple ID at confirmation of purchase.
An auto-renewable subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
You manage or cancel subscriptions in Settings › [your Apple ID] › Subscriptions. Deleting the App does not cancel a subscription.
Except where required by law, payments are non-refundable; refunds are handled by Apple under the App Store terms.
Any unused portion of a free trial is forfeited when you purchase a subscription.

3. Acceptable use

You agree not to: reverse engineer, decompile, or tamper with the App except as permitted by law; use the App unlawfully or to endanger yourself or others; interfere with its security or operation; or use it in any way that violates Apple’s or our providers’ terms.

4. Intellectual property

The App, including its design, text, graphics, and software, is owned by SunWise and its licensors and is protected by intellectual-property laws. Except for the license in §1, no rights are granted to you.

5. Third-party services

The App relies on third-party services including Apple (WeatherKit, HealthKit, StoreKit), Google Firebase, RevenueCat, and Superwall. Your use of those services may be subject to their own terms, and we are not responsible for third-party services. Weather, UV, and map data are provided “as is” and may be inaccurate, delayed, or unavailable.

6. Disclaimer of warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the App, its estimates, or its data will be accurate, uninterrupted, or error-free. You use the App at your own risk.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUNWISE AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM SUN EXPOSURE, HEALTH DECISIONS, OR RELIANCE ON THE APP’S ESTIMATES. Our total liability for any claim relating to the App will not exceed the amount you paid for the App in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

8. Termination

These Terms apply until terminated. Your license ends automatically if you breach them. You may end them by deleting the App. Sections that by their nature should survive (e.g. §§4, 6, 7, 9) survive termination.

9. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence apply. This does not limit Apple’s role as described in §11.

10. Changes

We may update these Terms. Material changes take effect when we post the updated Terms and update the “Last updated” date. Continued use after changes means you accept them.

11. Apple App Store — required terms

The following apply because the App is distributed through the Apple App Store:

These Terms are between you and SunWise only, not with Apple. Apple is not responsible for the App or its content.
Apple has no obligation to provide maintenance or support for the App.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are SunWise’s responsibility.
Apple is not responsible for addressing any claims by you or a third party relating to the App or your use of it, including product-liability, legal/regulatory, or consumer-protection claims.
For third-party intellectual-property infringement claims relating to the App, SunWise, not Apple, is responsible for investigation, defense, settlement, and discharge.
You represent that you are not located in a country subject to a U.S. Government embargo or designated a “terrorist-supporting” country, and are not on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
